Leaving
a gift in your will
It is a known fact
that many people do not make a will and, therefore, leave
their estate intestate. For those that have passed away it
means they did not get a chance to have their last wishes
listened to and carried out, and for those who remain behind
they are left with the problems of sorting out their loved
ones estate. This could all be avoided by making a will. Even
if you make it early you can always change or add to it by
making a codicil.
Some people may
have supported a charity all their life, and may wish to continue
supporting it when they have gone. An ideal way to do this
is to leave a legacy in their will, giving a gift to a charity,
(or often charities) close to their heart. This has proved
to be an excellent way for charities to continue to do their
work. Often a gift can fund a particular project, which could
make all the difference.
To leave a legacy
in your will we strongly advise you contact your solicitor,
who will go through all the details with you, to make sure
there are no problems when your will comes into effect.

There
are various ways of giving in your will. You can give: |

| A
specific gift |
A gift
of a single possession, such as some jewellery, an antique,
or an item of sentimental value. |

| A
pecuniary legacy |
Again, this is a
specific gift, but one of money. |

| A
general gift |
This relates to
an item that an individual currently owns - but might expect
to change during the course of their lifetime. One example of
this is a car. |

| A
demonstrative legacy |
This can either
be a general gift, or a pecuniary legacy, which is to be paid
for out of a specific building society or bank account, or other
fund - details of which can be stipulated in your will. |

| A
residuary gift |
Alternatively, an
individual may choose to leave the 'residue' of their estate
to a named individual or organisation. As the name implies,
this is the amount left once all specific gifts, and any debts
have been paid. |

If you are making
your first will you just need to add your legacy as part of
the contents. If you want to add to an existing will you will
need to draw up a codicil. This is basically an appendix to
your existing will. Your solicitor can advise you of the appropriate
wording and how many witnesses you will require. |
